Apple Standard EULA

Magic Overlay Maker is licensed to you, not sold. Your use of the version of the app distributed through Apple's App Store is also governed by Apple's Standard End User License Agreement (“Apple EULA”). These Terms supplement the Apple EULA.

Purchases and Lifetime Unlock

Magic Overlay Maker may offer an optional Lifetime Unlock as a one-time, non-subscription in-app purchase.

The Lifetime Unlock provides access to the premium features available in Magic Overlay Maker at the time of purchase, as well as premium features that we may later add to Magic Overlay Maker. Purchasing the Lifetime Unlock does not guarantee that any particular future feature will be developed or released.

The Lifetime Unlock applies to Magic Overlay Maker itself. It does not include separately sold apps, products, services, or other offerings that Magic Spark Builders, LLC may create in the future.

In-app purchases are processed by Apple and are subject to Apple's payment, purchase restoration, and refund policies. Apple determines eligibility for App Store refunds.

Your Content

You retain all rights you have in the photos, videos, audio, and other content you use with Magic Overlay Maker. We do not acquire ownership of your content.

Your media is processed on your device. Magic Overlay Maker does not upload your photos, videos, or created overlays to our servers.

Built-In Assets and Exported Videos

Magic Overlay Maker, including its software, design, branding, built-in effects, sounds, graphics, and other included materials, is owned by Magic Spark Builders, LLC or its licensors.

You may use videos you export from Magic Overlay Maker for personal or commercial purposes, subject to these Terms and any rights belonging to third parties.

This permission to use exported videos does not transfer ownership of Magic Overlay Maker or its underlying built-in assets to you and does not give you the right to extract, redistribute, sell, or license those assets separately from videos created using the app.

Your Responsibility for Content

You are responsible for making sure you have the rights necessary to use any photos, videos, music, logos, trademarks, or other material you bring into or use with Magic Overlay Maker.

Your use of the app and anything you create with it must comply with applicable laws and must not infringe the rights of others.

Privacy

Our Privacy Policy explains how information is handled in connection with Magic Overlay Maker.

Changes and Availability

We may update, improve, modify, or discontinue Magic Overlay Maker or particular features over time.

We do not guarantee that the app will always be available or remain compatible with every current or future device, operating system, or version of iOS.

Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, Magic Overlay Maker is provided on an “as is” and “as available” basis without warranties beyond those that cannot legally be excluded.

To the maximum extent permitted by applicable law, Magic Spark Builders, LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of, or inability to use, the app.

Nothing in these Terms limits any consumer rights or other rights that cannot legally be waived or limited. Additional warranty and liability provisions in the Apple EULA may also apply.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent that applicable law in your place of residence gives you rights that cannot be waived by these Terms.

Changes to These Terms

We may update these Terms from time to time. If we do, the updated Terms will be posted on this page with a new effective date.
